The Compliance Engine Terms of Use

 Each User must agree to all terms of use below in order to complete registration.

 By accessing and using The Compliance Engine System, I represent and warrant that:

• All information associated with any fire prevention & life safety inspection reports (the “Inspection Reports”) I submit to BRYCER, LP (“BRYCER”) is true and accurate.
• All my relevant licenses and registrations with the proper authority having jurisdiction (the “AHJ”) are current and valid at the time and date of any given fire prevention & life safety inspection test related to the Inspection Reports I submit to BRYCER.
• With respect to the information submitted to BRYCER with respect to a given fire prevention & life safety apparatus, Inspection Report, or general information related to the subject premises (the “Premises”), BRYCER will not:
  • Market your customer lists and data to third parties for marketing purposes
  • Distribute copies of inspection, testing and maintenance results to third parties for their marketing purposes
  • Respond to any FOIA request (BRYCER is not an agent of the AHJ)
  • Provide access to your customer data to third parties for bidding out of maintenance work
  • Perform inspection, testing and maintenance services
• All fire prevention & life safety inspection and test results (the “Inspection Reports”) and corresponding comments submitted with the relevant Inspection Report, are to be used by the Federal, State, and Local AHJs.
• All Inspection Results I submit to BRYCER are true and correct, and all tests deemed valid meet the relevant AHJs adopted codes for the subject Premises.
• I understand that the Inspection Reports must be submitted in conjunction with the relevant AHJ’s adopted codes and relevant due dates.  I understand (i) there will be a fee charged by BRYCER, which fee must be paid prior to submittal, and (ii) if such fee is not paid, the relevant Inspection Report will not be submitted to the relevant authority. The amount of the fee charged will be clearly stated but may vary by Inspection Report type and the relevant AHJ for my Premises.
• I understand that payment of all fees to BRYCER must be submitted using a valid credit card and that BRYCER utilizes the Paymentech platform to process payments
• All fees are non-refundable unless otherwise expressly noted in this policy or in a separate written agreement with BRYCER. BRYCER expressly reserves the right to change or modify its fees and policy at any time, and such changes or modifications shall be posted online at this site and effective immediately without need for further notice to you.
  
  • 90-Day Refund Window: Absolutely no refunds will be issued for any transaction more than 90 days after the original transaction date.
  • Tax Refunds: For tax-related refunds:
    • A refund will be issued only if there is a valid tax exemption certificate, the buyer is a genuine reseller, and the request is made within 90 days of the transaction.
    • In all other cases (requests past 90 days, or buyers who are not truly reselling), BRYCER will not issue a refund. We collected and remitted the tax correctly; you must file a refund claim directly with the applicable state taxing authority.
  • Refund Exceptions (Expressly Noted Cases): Notwithstanding the general non-refundable policy and 90-day limit, BRYCER may, in its sole discretion, issue refunds in the following limited circumstances:
    • The premises was fee-exempt (e.g., county or other government building) but was not properly labeled as exempt, resulting in the Service Provider being charged for the upload.
    • An Authority Having Jurisdiction (AHJ) accepted a property that was not in their jurisdiction, but the AHJ was charged for the report.
      
    • Bug-related errors in the BRYCER platform that resulted in errant charges
  • In these exception cases, BRYCER will review the request and determine eligibility. Refunds are not automatic and remain subject to BRYCER’s approval.
    
  • Refund Processing: Where refunds are issued, BRYCER’s issuance of a refund receipt is confirmation that BRYCER has submitted your refund to the payment method charged at the time of the original sale. You acknowledge and agree that the associated payment provider and/or individual issuing bank establish and regulate the time frames for posting your refund. Refund posting time frames may range from five business days to a full billing cycle.
  • Non-Payment and Chargebacks: If for any reason BRYCER is unable to charge your payment method for the full amount owed, or if BRYCER is charged a penalty or chargeback for any fee it previously charged to your payment method (including credit card), you agree that BRYCER may pursue all available lawful remedies in order to obtain payment.
  • Administrative/Processing Fees: BRYCER reserves the right to charge you reasonable administrative fees or processing fees for (i) tasks BRYCER may perform outside the normal scope of its services, and/or (ii) your noncompliance with these Terms of Use (as determined by BRYCER in its sole and absolute discretion)
    
• I understand that the relevant AHJ can utilize the The Compliance Engine system (the “Compliance Engine”) to request, at any time, the furnishing of my industry licenses, contractor license, or any other licenses or certifications required by the relevant AHJ.
• I understand that failure to comply with any aspect of these Terms of Use may result in my being forbidden from submitting Inspection Reports via the Compliance Engine.
• I understand that these Terms of Use shall apply to each Inspection Report I submit to BRYCER at any time.
• I understand that BRYCER may amend these Terms of Use at any time; provided that, in no event may Brycer amend the third bullet point of these Terms of Use regarding limitations on use of information.
• I understand that these Terms of Use, together with the BRYCER General Website Terms and Conditions and the BRYCER Privacy Policy, represent the entire agreement between BRYCER and me described herein and therein, and supersede any and all prior agreements, communications or understandings regarding the same.
